Australian Consumer Law (ACL) — Your Rights
Under the ACL, consumers have guarantees that services will be provided with due care and skill and that services will be reasonably fit for purpose. Where a failure occurs, remedies may include repair, refund or compensation depending on the situation and statutory rights.
- We aim to deliver services as described and to communicate any limits or exclusions before work begins.
- ACL rights are in addition to any manufacturer or third-party warranties and cannot be excluded where prohibited by law.
How to make an ACL claim
Contact our service team via Contacts with evidence (photos, logs, invoices). We will evaluate and propose a remedy consistent with ACL obligations.
Disclaimers & Liability
To the extent permitted by law, Superpromozone limits its liability for indirect or consequential loss arising from tuning work. We accept liability where required by statute (including ACL) and for direct losses caused by our negligence.
Customers must ensure vehicles are roadworthy and legally compliant post-modification. Where regulatory restrictions apply (emissions, ADR compliance, warranty implications), these are the customer's responsibility to confirm prior to commissioning work.
Limitations
- *** liability for pre-existing defects not disclosed.
- We do not guarantee outcomes for heavily modified or unreliably maintained vehicles.
Intellectual Property & Content
All code, tuning maps, documentation and content produced by Superpromozone remain our intellectual property unless otherwise agreed in writing. Customers receive a licence to use delivered tune files on the serviced vehicle(s) only.
Third-party software
We may use third-party tools under licence. Redistribution of licensed software or proprietary maps is prohibited.
